Nutri-E Terms of Service

By downloading, installing, or using Nutri-E ("the App"), you agree to these terms. The App is provided by Invotek AS ("we", "us", "our"), org.nr. 931 930 354, a company registered in Oslo, Norway. If you do not agree to these terms, do not use the App.

1. Age Requirement

You must be 18 years or older to use Nutri-E. Supplements can have serious health effects, and the App is designed for adult use only.

2. The Service

Nutri-E is a supplement and nutrition tracking application. It helps you:

• Track your daily supplement intake
• Monitor nutrient levels against reference daily values
• Read supplement labels and food photos using AI
• Set reminders and schedules for your supplements
• Review your own nutrition and adherence data over time

3. Medical Disclaimer

Nutri-E is not a medical device and does not provide medical advice, diagnosis, or treatment.

• The App is for information and tracking purposes only
• Health information in the App follows general guidelines and may not suit your individual situation
• Reference daily values are calculated from demographic data and general health recommendations
• Nutrition data extracted by AI may contain errors or omissions
• Always consult a qualified healthcare professional before starting, stopping, or changing any supplement regimen
• Do not rely on the App alone for health decisions
• If you experience adverse effects from any supplement, stop taking it and seek medical attention immediately

4. Your Responsibilities

You agree to:

• Enter accurate personal information (age, gender, health status) so that reference values are meaningful
• Verify all supplement and nutrition data the AI extracts before relying on it
• Use the App responsibly and not for any unlawful purpose
• Not reverse engineer, decompile, or attempt to extract the source code of the App
• Comply with all applicable laws and regulations

Nutri-E has no user accounts and no sign in, so there are no account credentials for you to keep secure. Your data lives on your device and is protected by your device passcode and biometric lock.

5. AI Features and Their Limits

Accuracy

The App uses OpenAI's GPT-4 models to extract nutrition information from what you scan. For supplement labels, the photo is read on your iPhone and only the recognised text is analysed. For meals, the photo itself is analysed by a vision model. Image quality, lighting, and label clarity all affect the result. Extracted data may contain errors, omissions, or inaccuracies. You are responsible for verifying it, and we are not liable for decisions you make based on it.

Usage limits

AI features are subject to usage limits based on your plan:

• Free: 10 AI requests to start, plus 3 more each week, up to a maximum of 10 stored. Credits earned above 10 are not carried over. Your balance, and when the next 3 arrive, are shown in the App.
• Basic: 10 AI requests per day, $4.99 per month
• Pro: 50 AI requests per day, $11.99 per month
• Premium: 160 AI requests per day, $24.99 per month
• Ultimate: 500 AI requests per day, $39.99 per month

Product lookups in the NIH Dietary Supplement Label Database do not consume AI requests, but they are subject to their own daily limit per device: 100 lookups on the Free and Basic plans, 500 on Pro, 2000 on Premium, and no practical limit on Ultimate.

Paid plan daily limits reset at midnight UTC. Free requests accrue weekly, as described above. Unlimited supplement tracking, reference value calculation, schedules, nutrient summaries, and data export are included at no cost on every plan.

6. Subscriptions and Payments

Nutri-E offers optional monthly subscriptions through the Apple App Store:

• All plans are billed monthly. There is no annual plan.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period
• Payment is charged to your Apple ID account
• Manage or cancel your subscription in Settings, then Apple ID, then Subscriptions on your device
• Cancellation takes effect at the end of the current billing period, and paid features remain available until then
• Refunds are handled by Apple according to Apple's refund policy

We may change subscription prices. You will be notified at least 30 days before any price increase, and continued use after the change constitutes acceptance.

7. Data and Privacy

Your supplement records, dose history, health details, and schedules are stored on your device. Text read from supplement labels on your device, photos of meals, and food descriptions you submit for AI analysis are sent to servers we operate and forwarded to OpenAI, and product searches are forwarded to the NIH Dietary Supplement Label Database. Our servers also hold usage counters and your subscription status against a pseudonymous device identifier. We do not sell or share your personal data with third parties for marketing.

The Nutri-E Privacy Policy sets out in full what leaves your device, who receives it, and what rights you have over it. It forms part of these terms.

8. Intellectual Property

The App, including all content, features, branding, and functionality, is owned by Invotek AS and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute the App, reverse engineer it, remove copyright or trademark notices, or use the Nutri-E name, logo, or branding without our written consent.

9. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" without warranties of any kind
• We are not liable for health issues, injuries, or adverse effects resulting from supplement use
• We are not liable for decisions made based on data or insights shown in the App
• We are not liable for data loss, device damage, or service interruptions
• Our total liability is limited to the amount you paid for the App in the last 12 months

10. Third Party Services

The App relies on third party services, and we are not responsible for their availability, accuracy, or content:

• OpenAI (GPT-4 models): subject to OpenAI's terms and privacy policy
• NIH Dietary Supplement Label Database: subject to the NIH terms of use
• Apple: in-app purchases and subscriptions are subject to Apple's terms
• Cloudflare: our servers run on Cloudflare infrastructure

11. Termination

We may suspend or end your access if you breach these terms, and we may discontinue the App or any of its features at any time. On termination you must delete the App from all your devices.

12. Indemnification

You agree to indemnify and hold Invotek AS harmless from any claims, damages, or expenses arising from your use of the App, your breach of these terms, health decisions you make based on App data, or your violation of any third party rights.

13. Governing Law

These terms are governed by the laws of Norway, and disputes will be resolved in the courts of Oslo, Norway. If you are in the EU or EEA, your GDPR rights apply. If you are in California, your CCPA rights apply. Both are set out in the Privacy Policy.

14. Changes to These Terms

We may update these terms from time to time. Significant changes will be announced in the App or on this page. Continued use of the App after a change constitutes acceptance of the updated terms.

15. Severability and Entire Agreement

If any provision of these terms is found invalid or unenforceable, the remaining provisions stay in full force. These terms, together with the Privacy Policy, form the entire agreement between you and Invotek AS regarding your use of the App.
